Terms of Service

By downloading, installing, or using the BUKHASDATALINK mobile application or website ("Platform"), you agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, do not use the Platform. These Terms constitute a binding agreement between you and Sofix Digital Technologies Ltd trading as BUKHASDATALINK (RC 9342546), a company registered in the Federal Republic of Nigeria ("Company", "we", "us", or "our"). We reserve the right to update these Terms at any time. Continued use of the Platform after any changes constitutes acceptance of the revised Terms.

You must be at least 18 years old to use the Platform. By using the Platform you represent and warrant that: • You are at least 18 years of age. • You are a resident of Nigeria or are otherwise legally permitted to use our services. • You have the legal capacity to enter into a binding contract. • You are not on any government sanctions list. • All information you provide is accurate and current. We reserve the right to suspend or terminate any account where eligibility requirements are not met.

To access most features of the Platform you must create an account. You agree to: • Provide accurate, current, and complete registration information. • Maintain the security of your password and transaction PIN. • Not share your account credentials with any third party. • Notify us immediately at support@bukhasdatalink.com.ng if you suspect unauthorised access to your account. • Accept responsibility for all activity that occurs under your account. We reserve the right to refuse registration or cancel accounts at our discretion, particularly where we reasonably suspect fraud, abuse, or violation of these Terms.

4.1 Wallet funding — Your BUKHASDATALINK wallet is funded by transferring money to your assigned virtual bank account or via supported payment channels. Funds are credited to your wallet upon confirmed receipt by us. 4.2 Wallet balance — Your wallet balance is not a bank deposit and does not earn interest. It may only be used to purchase services available on the Platform. 4.3 Withdrawals — Wallet balances are non-withdrawable except as specifically permitted in the app. We may introduce a withdrawal feature at our discretion. 4.4 Failed transactions — If a transaction fails after your wallet has been debited, an automatic refund will be credited to your wallet within 24 hours. If you do not receive a refund contact support immediately. 4.5 No chargebacks — All wallet funding transactions are final once credited. We do not process chargebacks through third-party payment providers for wallet top-ups. 4.6 Minimum balance — We may set minimum wallet balance requirements for certain services at any time.

5.1 Airtime top-up — Airtime is delivered to the specified phone number. Once delivered, airtime cannot be reversed. Ensure the phone number is correct before confirming. 5.2 Data bundles — Data plans are purchased at your request and delivered directly to the specified number. Ensure network compatibility before purchase. No refund is available once a data bundle has been delivered. 5.3 Cable TV subscriptions — Subscription renewals are processed directly with the broadcaster. Ensure your IUC/smartcard number is correct. Successfully processed subscriptions are non-refundable. 5.4 Utility payments — Electricity token purchases are irreversible once the token has been generated and delivered. Verify your meter number before confirming. 5.5 Identity verification — BVN, NIMC, and other identity lookups are performed via licensed data bureaux. Results reflect data held in government databases. We are not liable for inaccuracies in underlying government data. 5.6 Availability — We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance, third-party network outages, and regulatory actions may affect availability.

6.1 Eligibility — Any registered user may participate in our reseller and referral programme subject to these Terms and any additional programme-specific terms we publish. 6.2 Commissions — Referral commissions are calculated based on your referrals' qualifying transactions and credited to your wallet. Commission rates are set by us and may change with notice. 6.3 Misuse — Any attempt to artificially inflate referral counts, self-refer, or otherwise abuse the programme will result in forfeiture of commissions and account suspension. 6.4 Tax — You are solely responsible for declaring and paying any applicable taxes on commissions earned through the Platform.

You agree not to: • Use the Platform for any unlawful purpose or in violation of any applicable Nigerian or international law. • Use the Platform to fund or facilitate terrorism, money laundering, or other financial crimes. • Attempt to gain unauthorised access to any part of the Platform or its infrastructure. • Reverse-engineer, decompile, or disassemble any part of the Platform. • Use automated scripts, bots, or scrapers to access the Platform. • Provide false identity information or impersonate another person. • Engage in fraudulent transactions or collude with third parties to defraud us or other users. • Harass, abuse, or threaten our support staff or other users. • Reproduce, duplicate, or sell any part of the Platform without written permission. Violation of any of the above may result in immediate account suspension, forfeiture of wallet balance where fraud is proven, and referral to law enforcement.

All content on the Platform — including but not limited to the name "BUKHASDATALINK", logos, graphics, user interface design, source code, and written content — is the exclusive property of Sofix Digital Technologies Ltd and is protected by Nigerian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for its intended personal or business purposes. You may not use our intellectual property for any other purpose without our prior written consent.

9.1 The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. 9.2 We do not warrant that the Platform will be error-free, virus-free, or continuously available. 9.3 To the fullest extent permitted by Nigerian law, we shall not be liable for: • Indirect, incidental, or consequential losses arising from your use of the Platform. • Loss of data, revenue, or profits. • Errors or delays caused by third-party networks, payment processors, or government databases. • Losses arising from unauthorised access to your account due to your failure to keep credentials secure. 9.4 Our maximum aggregate liability to you for any claim arising from use of the Platform shall not exceed the total value of the specific transaction giving rise to the claim.

You agree to indemnify, defend, and hold harmless BUKHASDATALINK, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: • Your use of or inability to use the Platform. • Your breach of these Terms. • Your violation of any law or third-party rights. • Any fraudulent or illegal activity conducted through your account.

11.1 By you — You may close your account at any time by contacting support@bukhasdatalink.com.ng. Any unused wallet balance at the time of closure that is not subject to a hold or investigation will be reviewed for refund on a case-by-case basis. 11.2 By us — We may suspend or terminate your account immediately, without notice, if we determine at our sole discretion that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the Platform or other users. 11.3 Effect of termination — Upon termination, your right to use the Platform ceases. Sections that by their nature should survive termination (including Sections 8, 9, 10, and 13) will continue to apply.

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising out of or in connection with these Terms that cannot be resolved through good-faith negotiation within 30 days shall be referred to binding arbitration in Abuja, Nigeria, in accordance with the Arbitration and Conciliation Act (Cap A18 LFN 2004). Nothing in this clause prevents either party from seeking urgent injunctive or declaratory relief from a Nigerian court.

Entire agreement — These Terms together with our Privacy Policy constitute the entire agreement between you and BUKHASDATALINK regarding use of the Platform. Severability — If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. No waiver — Our failure to enforce any right or provision does not constitute a waiver of that right or provision. Assignment — We may assign our rights and obligations under these Terms at any time. You may not assign your rights without our prior written consent. Force majeure — We will not be liable for delays or failures caused by events beyond our reasonable control, including government actions, natural disasters, or telecommunications failures.
